JTS has secured a lawful development certificate for the existing use of a property as a single self-contained dwellinghouse (use class C3). The property had been subject to a historic condition limiting its occupancy to staff accommodation for an adjacent care home. JTS successfully demonstrated that the condition had been in breach in excess of 4 years and therefore the use of the property as a single self-contained dwelling was immune from enforcement action and therefore lawful.
